WILL OF JARROT PHELPS In the name of God. Amen January 23,1851 I Jarrot Phelps, being of sound mind and memory and wishing to make final disposition of all my worldly effects, do ordain and publish this to be my last will and testament, viz: First. That all my just debts be paid. Second. That my wife Milly Phelps shall enjoy the undisturbed use and possession of all my estate left during her natural life should she survived me. Third. My son George Phelps and my son-in-law William Stone shall take each one sixth part of my estate. Fourth. I give to said William Stone and George Phelps jointly two sixths of my estate to be held and managed by them for the use and benefit of my two daughters Elizabeth Turner and Susan Grosheart, said Stone and Phelps being joint trustees to hold said two sixths for the separate use of said daughters until the death of each, upon the happening of which event to each one, her portion shall belong to her heirs. Fifth. My son Charles D. Phelps shall take one sixth part of my estate. Sixth. I give to George Phelps and William Stone Jointly, one sixth part of my estate to be held by them for use and benefit of my daughter Sally Ann Embry during her natural life, to pass at her death to her heirs, unless she shall by testament otherwise direct, in which case it shall pass to any person or persons she may select. signed Jarrot Phelps Witnesses Samuel Williams and J.C. In addition to the foregoing, I direct the following disposition to be made of certain notes herein mentioned viz, One note from William Stone to me for three thousand two hundred and sixty nine dollars bearing date January 23, 1851 to be divided as follows viz ,To William Stone three hundred and thirty seven dollars. To George Phelps Five hundred and fifty dollars. To Charles Phelps Five hundred and sixty seven dollars. To George Phelps and William Stone in trust for Susan Grosheart ( the trust being similar to that of clause fourth above ) eight hundred and forty-nine dollars. To same trustees for Elizabeth Turner Four hundred and eighty-nine dollars, and also a note held by me against Fountain Turner for Three hundred dollars bearing date October 20, 1848, This tust also according to clause fourth. To same trustees for Sally Ann Embry Four hundred and seventy-seven dollars ( to come out of Stone's note ) and also a note held by me against Wiley Embry for Two hundred and fifty dollars bearing date October 3, 1831 and having a credit of One hundred dollars, dated December 20, 1848. This trust being subject to the conditions mentioned in clause sixth above. It is my intention to make these bequests and trusts mentioned in the clause before my death; but in case I should not do so then I direct my executors to execute them next in order to clause First above. Eighth. I hereby appoint George Phelps and William Stone Executors of this will, or in case of their death or refusal to act either of them, then, first Josiah Simmons and next Achilles Deatherage. ESTATE OF JARROT PHELPS INDENTURE State of Kentucky Madison County I Thomas H. Barnes Clerk of the County Court for said County do certify that the foregoing deed and certificate were on the 7 th day of October 1857, produced to me and ordered to be recorded. Whereupon said deed and certificate with this certificate have been duly recorded in my office. Att. Tho. H Barnes C.M.C.C INDENTURE PAGE 2 This Indenture made and entered into this 17 day of January 1857, by and between Charles D. Phelps and Mary Ann his wife. Fountain Turner and Elizabeth, his wife. Samuel Grosshart and Susan, his wife, of the County of Cole and State of Illinois and William Stone and Mildred, his wife Wiley Embry and Sally, his wife and Mildred Phelps of the County of Madison and State of Kentucky of the first part and George Phelps of the second part. Witnessed that the said parties of the first part for and in consideration of the sum of eight-hundred and forty dollars paid to Jarrot Phelps, the Father, and husband of the parties of the first and to Charles Phelps, and also in consideration that said Jarrot Phelps had given in writting, the land herein named to his sons George and Charles, and the said Charles has sold his share to the said George Phelps. Now in consideration of the premises the said parties of the first part have bargained and sold and do by these presents bargain, sell and convey unto the said George Phelps, the following tract or parcels of land lying in Madison County, Kentucky, on the waters of Taylors arook of Silver Creek the first tract bounded as follows. Beginning at three elms growing from one root = William Stones corner, thence S1 71 1/2 & E 71 to a rook Stones corner in _____line, thence S 11 1/4 W 65 ___passing Willis corner to a stake formerly R. Johnsons. Now said George Phelps corner in the William Davis line thence, N 70 & a half W 131 poles to an elm on the South bank of a branch of Robinsons Mill Road, thence along the road up the branch N 7 3/4 W 23 poles N 2 1/2 W 18 1/2 poles to a rock on the west side of the branch thence, S 30 E 15 poles to a rock on a hill side thence, S 72 1/4 E 57 poles to a small black locust in the field, thence, N 19 E 33 9/10 poles to the beginning. And the said parties of the first part also _____unto said George Phelps all the lands embraced in a deed from Evan Scott and wife to Jarrot Phelps, dated 19 of Nov. 1822 and of record in the County Courts Clerks office of Madison County, Kentucky excepting however from this conveyance so much of the lands embraced in that deed as Jarrot Phelps and wife have heretofore conveyed to Wiley Embry by deed dated the 9 th day of November 1850 of record in the Madison County, Kentucky Clerks Office. To have and to hold said land together with all and singular the __________there to belonging to the said George Phelps and his heirs and ______forever.
